Scope and contract priority
These website terms describe the standard framework for equipment rental enquiries. Every rental remains subject to availability, customer due diligence, an approved quotation and a signed rental agreement. If these website terms conflict with an executed quotation or rental agreement, the executed document takes priority.
Quotations, rates and availability
Equipment availability, rental period, minimum hire, rate basis, taxes, mobilisation, demobilisation, fuel, operators, maintenance coverage, deposits and any project-specific charges are confirmed in the approved quotation. Catalogue information does not reserve equipment or guarantee a particular unit until Apex issues written confirmation.
Hirer responsibilities and permitted use
The hirer must provide accurate site and application information, suitable access and safe operating conditions. Equipment may be used only for the agreed purpose, at the approved location and by competent, authorised operators in accordance with manufacturer instructions, site rules and applicable safety requirements. Sub-hire, relocation, alteration or attachment changes require prior written approval.
Delivery, mobilisation and acceptance
Mobilisation timing depends on access readiness, permits, transport conditions and the agreed handover plan. At delivery, the parties should record equipment identity, condition, meter readings, fuel level, accessories and any visible exception. Continued use after handover constitutes acceptance subject to defects promptly recorded through the agreed reporting channel.
Care, inspections, maintenance and breakdowns
The hirer must complete required pre-start checks, protect the equipment from misuse and stop operation when a condition may be unsafe or cause further damage. Breakdowns, warning indicators, incidents and damage must be reported promptly. Maintenance responsibilities, service access, consumables and authorised repair arrangements are defined in the signed rental agreement; unauthorised repairs or modifications are not permitted.
Damage, loss and insurance
Responsibility for loss, theft, damage, recovery, security, insurance and any applicable excess is established in the signed rental agreement. The hirer must preserve evidence, notify Apex promptly and cooperate with incident, insurer and recovery requirements. Nothing on this website predetermines liability for a specific event.
Rental period, off-hire and return
The rental start, chargeable period and off-hire process are those stated in the executed documents. A request to stop using equipment does not by itself end rental charges unless the agreed off-hire procedure is completed. Equipment must be returned to the agreed location and condition with all supplied accessories, records and keys; final condition, meter, fuel, cleaning, damage and transport adjustments may be reconciled at return.
GPS, telematics and fleet visibility
Where a rental unit carries an approved GPS or telematics device, Apex may process location, operating-hour, ignition, maintenance and equipment-status data for safety, asset security, service coordination, contract administration and authorised operational reporting. Access is restricted and handled in accordance with the applicable privacy notice, signed agreement and approved customer permissions.
Invoices, payment and disputes
Invoice timing, payment due dates, credit terms, late-payment consequences and supporting records are set out in the approved commercial documents. A customer should raise a good-faith invoice query promptly while paying any undisputed amount when due. Governing law, escalation and dispute-resolution arrangements are defined in the signed rental agreement.
